2. Applicability These Terms of Service apply to every offer made by Deathly Smooth and to every agreement established between Deathly Smooth and the consumer or business client, unless otherwise agreed in writing. For wholesale or resale inquiries, contact us first at info@deathlysmooth.com.
3. Offers and Agreements All offers on our website are non-binding. Obvious errors or mistakes do not bind us. An agreement is formed once the customer places an order and receives confirmation via email.
Orders are subject to acceptance. We reserve the right to refuse any order at our sole discretion and may limit or cancel quantities per person, per household, or per order. We may attempt to notify you via the email and/or billing address provided at the time of order. We also reserve the right to prohibit orders that appear to be placed by resellers or distributors.
We reserve the right to modify or discontinue products or services at any time without prior notice.
4. Prices and Payment All prices include VAT and exclude shipping costs unless stated otherwise.
Payment is made in advance using the following methods: Visa, Mastercard, American Express, Apple Pay, Google Pay, iDEAL, Maestro, Shop Pay, UnionPay.
Prices are subject to change without notice.
5. Shipping and Fulfillment We ship within the EU. Worldwide shipping is available on request.
We primarily use DHL but reserve the right to use any carrier necessary to ensure a smooth delivery.
Shipping costs are calculated automatically during checkout. Estimated delivery times are displayed during checkout or on the product page.
Delivery times provided are estimates. We are not responsible for delays caused by carriers, customs, or unforeseen circumstances. Risk of loss and title for purchased items pass to you upon delivery to the carrier.
If an order does not arrive, we will send a replacement or issue a refund. If a product arrives damaged and becomes unusable, we will send a replacement free of charge.
6. Right of Withdrawal (Return Policy) Consumers have the right to withdraw from their purchase within 30 days of receiving the product without providing a reason.
Exceptions:
Opened products cannot be returned due to hygiene concerns related to skincare.
Return shipping costs are always the responsibility of the customer. If the entire order is returned, we will also refund the original shipping costs. If only part of the order is returned, shipping costs will not be refunded.
Returns are subject to our Return & Refund Policy available on our website. We reserve the right to refuse returns that do not comply with our policy.
Refunds will be issued within 14 days after we receive the returned items, using the same payment method as the original purchase.
7. Warranty and Liability Our products are covered by the legal conformity warranty. This means we guarantee that our products are safe, properly packaged, and conform to the stated specifications. We do not offer guarantees on individual skincare results, as every skin is unique.
We are not responsible for any adverse reactions or damages caused by improper use of our skincare products. Customers are expected to follow usage instructions and perform a patch test if necessary.
We are not liable for indirect, incidental, special, punitive, or consequential damages, unless there is willful misconduct or gross negligence on our part.
We are not liable for any failure or delay in performance due to unforeseen circumstances beyond our control, including but not limited to natural disasters, acts of war, labor strikes, supply chain disruptions, or government actions.
8. Intellectual Property All content on this website, including product descriptions, images, logos, and trademarks, is the exclusive property of Deathly Smooth and may not be copied, reproduced, or used without prior written permission.
9. Complaints Complaints can be sent to customerservice@deathlysmooth.com. We aim to respond within 5 business days. If a complaint cannot be resolved in mutual consultation, only the court in Rotterdam has jurisdiction to handle the dispute.
10. Applicable Law and Jurisdiction These terms are governed by Dutch law. All disputes will be submitted exclusively to the competent court in Rotterdam, the Netherlands.
11. Changes to the Terms Deathly Smooth reserves the right to change these terms at any time. The most current version will always be available on our website. In case of substantial changes, customers will be notified.
Your continued use of our website or services after any changes have been posted constitutes your acceptance of those changes.
12. Entire Agreement and Severability These terms and any policies or operating rules posted by us on this site constitute the entire agreement between you and Deathly Smooth. If any provision is determined to be unlawful, void, or unenforceable, the remaining provisions shall remain valid and enforceable to the fullest extent permitted by law.
ARTICLE X – PRE-ORDERS

What the hell is a pre-order?
A pre-order means you’re reserving a product that’s still in production or on its way to our warehouse. You’re basically first in line before the rest of the world gets it. -
Payment
Pre-orders are paid in full at the moment of purchase. That locks in your spot and helps us make sure your batch actually gets produced. -
Estimated delivery
Each pre-order product shows an expected delivery window. This date is an estimate — not a blood pact. Delays can happen because of manufacturing, customs, or logistics. We’ll update you if timing shifts. -
Cancellation before shipment
Changed your mind before your order ships?
No drama — email us at customerservice@deathlysmooth.com with your order number and we’ll cancel it. Any payments will be refunded within 14 days. -
Right of withdrawal
Your legal right of withdrawal (14 days) starts the moment you receive the product, not when you place the pre-order.
That’s EU law. We don’t make the rules — we just play by them. -
Delays or product changes
Deathly Smooth isn’t liable for delays beyond our control (production hiccups, customs, alien invasions, etc.).
If a product can’t be delivered at all, you’ll get a full refund — no questions asked.
